If you rent from the council and they have failed to fix damp, mould, leaks or broken heating, you could claim compensation and force the repairs. Your council is your landlord, so it has the same legal duties as any other. Checking is free, takes about 60 seconds, and it will not affect your tenancy.
Your council is still your landlord
Councils have to keep your home in repair, just like any other landlord. Those duties come from Section 11 of the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018. That covers the structure and outside of your home, damp and mould, heating and hot water, and the plumbing, gas and electrics.
Budget cuts and long waiting lists are not a legal excuse. If you have reported a problem and your council has not put it right in a reasonable time, you may have a housing disrepair claim.
Damp, mould and Awaab’s Law
After the death of two-year-old Awaab Ishak from mould in social housing, the government brought in Awaab’s Law. It sets strict time limits for social landlords, including councils, to investigate and fix damp and mould and other serious hazards. If your council has left you living with mould, this is one of the strongest reasons to act.
What you can claim for
- Compensation for the stress, discomfort and disruption of living with disrepair
- Damage to your belongings: carpets, furniture and clothes ruined by damp or leaks
- Higher heating bills caused by cold, draughty or broken systems
- The impact on your health, or a family member’s health
You still pay your rent while the dispute is going on. Never stop paying, as that can put your tenancy at risk. You claim the compensation legally instead.
