Damp and mould are among the most common and most serious housing disrepair problems. If you have reported damp or mould to your landlord and it has not been dealt with, you could be owed compensation and get the work done. The check is free, takes about 60 seconds, and will not affect your tenancy.

Your landlord has to deal with damp and mould

Under Section 11 of the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018, your landlord must keep your home free from serious hazards, and damp and mould are exactly that. It does not matter whether you rent from the council or a housing association.

Being told to “just open the windows” or “wipe it down” is not a fix. If the underlying cause (a leak, poor ventilation or a failed damp-proof course) has not been put right, the problem is theirs to solve, not yours.

Awaab’s Law and the health risks

Mould was ruled a cause of the death of two-year-old Awaab Ishak in social housing. In response, Awaab’s Law now sets strict time limits for social landlords to investigate and fix damp and mould. Prolonged exposure can trigger or worsen asthma, chest infections and other respiratory problems, especially for children, older people and anyone with existing health conditions.

If you or your family have been left living with mould, this is one of the strongest reasons to check your claim today.

What you can claim for

  • Compensation for the distress, discomfort and disruption of living with damp and mould
  • Belongings ruined by damp: clothes, furniture, carpets and bedding
  • Higher heating bills from a cold, damp home
  • The impact on your health, or a family member’s health

Keep paying your rent throughout. Never withhold it, as that can put your home at risk. You recover money through a compensation claim instead. If you qualify, a specialist solicitor from our panel takes it forward on a No Win, No Fee basis.

Frequently asked questions

Can I claim compensation for damp and mould?
Yes. If you reported damp or mould to your landlord and they failed to fix it within a reasonable time, you can claim compensation on a No Win, No Fee basis, and push to get it treated properly.
My landlord blames condensation and me. Can I still claim?
Often, yes. Landlords frequently blame “lifestyle”, but persistent mould is usually caused by an underlying defect such as a leak, poor ventilation or failed damp-proofing, which is the landlord’s responsibility to fix.
How much compensation could I get for mould?
There is no fixed amount. It depends on how serious and long-standing the problem is and how it has affected you, and it is assessed by a solicitor on your evidence, alongside getting the repairs done.
Will claiming affect my tenancy?
No. It is illegal for a landlord to evict you simply for reporting disrepair or making a legitimate claim. The free check on this page takes about 60 seconds.
