If you rent from a housing association and they have failed to fix damp, mould, leaks or heating problems, you could claim compensation and force the repairs. Housing associations are social landlords with clear legal duties, and they have to keep your home safe and in good repair. The check is free and will not affect your tenancy.

Housing associations have to keep your home in repair

Housing associations must meet the same standards as any landlord under Section 11 of the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018. They are also regulated as social landlords, so they usually have clear repair timescales and a complaints process.

If you have followed that process, or you have simply reported the problem and been ignored, and the disrepair is still there, you may have a claim.

Damp and mould: Awaab’s Law applies

Awaab’s Law, brought in after a child died from mould in social housing, sets strict deadlines for social landlords, including housing associations, to investigate and fix damp and mould. If your association has left you living with mould, do not accept it. Check your claim.

What you could be owed

  • Compensation for the stress and disruption of living with the problem
  • Damaged belongings: furniture, carpets and clothing
  • Extra costs, such as higher energy bills from a cold or damp home
  • Any effect on your health or your family’s health

Keep paying your rent throughout. Withholding rent can risk your home. You recover money through a compensation claim instead.

Frequently asked questions

Can I claim against my housing association?
Yes. If your housing association has failed to fix a reported repair within a reasonable time, you can make a housing disrepair claim for compensation, on a No Win, No Fee basis.
Do I have to use the complaints process first?
It helps to report the problem in writing and give them a fair chance to fix it. But if urgent repairs are being ignored, you do not have to wait forever. Check your options now.
Can they evict me for claiming?
No. It is illegal to evict you simply for requesting repairs or bringing a legitimate claim. Social tenants have strong protection against revenge evictions.
Is there any cost to me?
No. The check is free and claims run on a No Win, No Fee basis, so you pay nothing unless the claim succeeds.
